Working in Indonesia is an attractive option for many skilled foreign workers from all over the world. To work in Indonesia, a foreigner must already have a job offer from an Indonesian employer.

Before we go further, we would like to explain the following terms:

VITAS

This stands for Visa Izin Tinggal Terbatas, which is a Temporary (Limited) Stay Permit obtained from the Indonesian Representative abroad (Consulate/Embassy). It allows you to enter Indonesian territory.

However, since the Covid19 pandemic began, the issuance of VITAS has been stopped as the foreigners no longer need to visit the Indonesian Embassy abroad. Instead, they can fly directly to Indonesia, simply by holding an Electronic Visa (E-Visa) issued by the Directorate General of Immigration (DGI) in Jakarta.

ITAS

This stands for Izin Tinggal Terbatas. It is the valid Temporary Stay Permit stamped on your passport page. You will obtain the ITAS by converting the VITAS (E-Visa) at the immigration office in your area of stay, after you have arrived in Indonesia.

KITAS

Kartu Izin Tinggal Terbatas. After obtaining the ITAS on your passport page, the immigration will issue a KITAS document as your residence ID in Indonesia.

Work Permit and Stay Permit

First of all, please note that a work permit for expatriates in Indonesia is called an IMTA (Izin Memperkerjakan Tenaga Kerja Asing). Before obtaining this IMTA, your employer must first apply for an RPTKA.

The RPTKA itself stands for Rencana Penggunaan Tenaga Kerja Asing, which is an Expatriate Placement Plan required by the Indonesian Ministry of Manpower (MoM). It serves as a prerequisite for hiring a foreign worker, outlining the details of company sponsor, the term of employment, job position, and the permitted work area.

Please be aware that when you are in the process of applying for an IMTA, a mandatory Foreign Workers Utilization Compensation Fund (DPKK) of US$100 per month will apply. This fee is payable in Indonesia and is calculated upfront based on the length of the work permit (e.g., US$600 for 6 months, or US$1,200 for 1 year).

Upon the issuance of the RPTKA and IMTA, the Immigration Authority will grant you a Limited Stay Permit (Working KITAS) with a benefit of Multiple Exit Re-entry Permit (MERP).

Know the Eligibility

There are general things that foreigners and sponsoring companies must know while applying for a work KITAS.

For foreigners, you will need to

  1. Ensure that you have received a job offer from a company in Indonesia.
  2. Possess a certificate of competency or have at least 5 years of work experience relevant to the position.
  3. Transfer your expertise to assist local co-workers.

Additionally, the following fields of work are not available to you

  1. Human Resources
  2. Legal
  3. Supply Chain Management
  4. Health, Safety, and Environment
  5. Quality Control

Meanwhile, for the company, you are eligible to hire a foreign worker if your stated capital value is at least IDR 1 billion and is in the form of a local PT (Local Investment), a PMA (Foreign Investment Company), or a Representative Office (RO).

From the Applicant (foreign worker)
  1. Scanned copy of passport and passport cover. Passport validity is not less than 18 (eighteen) months expiration from the application date.
  2. Recent photograph, red background.
  3. CV and work experiences profile.
  4. Degree certificates and academic background supporting certificates.
  5. Details of staying address when in Indonesia, email address, and contactable phone number.
  6. Health insurance; or you may replace with a statement letter willing to cover your own medical costs while in Indonesia.
From the Employer (company sponsor)
  1. Deed of Establishment and the latest amendment if any
  2. Decree Approval from MoLHR and its amendment if any.
  3. Mandatory Manpower Report for the current year.
  4. Company’s Tax Number (NPWP).
  5. OSS documents (NIB, PKKPR, Standar Sertifikat)
  6. BPJS Registration Certificate
  7. ID card of local Director (if Indonesian); or passport and KITAS if foreign Director.
  8. ID card of local staff counterpart (KTP staff pendamping TKA).
  9. Work Contract (for non-Director position) – we provide the draft in accordance with Manpower Ministry requirement.
  10. Company’s bank account statement – minimum balance of US$2,000.
  11. Login (username) on the Manpower system and Immigration system (if registered already).

Payment can be made via bank transfer or in cash at your convenience.

Please note that fees are to be paid in full in advance. The visa application process will begin once both the invoice is settled and all required documents are completed

Work KITAS Photo and Issuance

Upon entering Indonesia with the issued work visa, your photo will be taken at the immigration checkpoint.

The Work KITAS will be issued by the airport immigration system within 1-3 working days

KITAS Photo Issues Resolution

If there are any issues with the photo display on the KITAS, Emicon will assist in resubmitting the KITAS from the sub-immigration office.

Switching Status for Visitor Visa Holders (index B211)

Authorization to Start Working

Legal employment can commence once the KITAS document is issued.

KITAS with Multiple Exit Reentry Permit (MERP)

The KITAS comes with a MERP during its validity, allowing for unlimited entries and exits from the country.

Dependent KITAS for Family Members

Spouses and children can also obtain a KITAS, known as Dependent KITAS, with a validity linked to the main KITAS holder

According to Minister of Manpower regulation (number 10 Year 2018, article 10, and number 8 Year 2021, article 30), foreign directors and commissioners with specific shareholdings are exempted from the RPTKA-IMTA application. Instead, you should apply for an Investor KITAS.

No, you should stick to the location specified in your work permit.

While it’s not clearly regulated, in practice, Indonesian companies have been advised to maintain a ratio of 3 local employees to 1 foreign worker. However, in recent years, there can be certain conditions to have at least 10 local employees to hire 1 expatriate.

No, that would violate your work permit. Be mindful of details like what you put on your business card or share on your social media, as it must align with your work permit occupation.

Unfortunately, you are not allowed to work until you have your KITAS. Even if you or your employer have obtained the IMTA, you still need to wait for the KITAS to be issued to avoid potential fines.
